| Group Description: | Having been involved in property sales in Turkey since 2002, I have encountered many problems in relation to obtaining Tapu'
The biggest problem is where builders do not own the land and have contracts/agreements with landowners. When it comes to getting the Tapu transferred, many landowners refuse to hand over the Tapu as either they have not been paid by the builder or they simply want more money - especially if they happen to get sight of the builders sale prices. Turkish solicitors become involved and with the Turkish legal system notoriously slow, people can spend many years in court having their finances depleted by the Solicitors - who in many cases are just milking the system.
I am aware of one case where a Judge visited a development where the landowner was refusing to hand over the Tapu's (the landowner was stating that it was not finished) and even after the Judge commissioned and received a copy of an independents surveyors report confirming the development was completed - he still refused to rule on the case. Two more Judges were appointed and each refused to rule and kept deferring the matter to the next court.
Another case is where an Emlak/developer built and sold eight apartments (receiving full payment for each apartment), refused to hand over the Tapu's and instead, changed the locks and moved some of his family into the various apartments - in full view of some of the people that purchased in the development. This Emlak/developer's actions were brought to the attention of the relevant authorities and despite numerous other stories about him and his company, he continues to operate freely without fear of being prosecuted. This case has been going on for four years without any end in sight. In the meantime, the people that purchased the eight apartments are being milked for fees by their Turkish Solicitors.
There are many stories coming from Turkey of such events and people buying there should be very careful where they buy and who they buy from. Judging by the many stories I have come across, it would seem that the legal system in Turkey favours the Turkish national ahead of the non-national. There also seems to be a belief that citizens from Europe are loaded and that they can afford to pay a bit extra.
Many people have successfully bought property in Turkey with no problem what so ever but a growing number have not been so lucky. Turkey is a lovely country with great people, food and climate. It’s an ideal place to buy a retirement property but it can prove to be a costly place if you do not get things right from the beginning. It is difficult to find if the developer owns the land or has the Tapu's but do not buy from any Emlak/developer that does not own the land. Power of Authority is a common way of buying property in Turkey but my advice is to employ a Solicitor from the outset. Do not hand over any money until you are 100% sure you will get your property and Tapu.
